Bewaved – Terms & Conditions

These Terms and Conditions (“Agreement”) govern your (“Client”, “you”) participation in the Bewaved program (“Program”) operated by Bewaved (“Company”, “we”, “us”). Please read carefully before enrolling. By enrolling in the Program, you agree to these Terms.
1. Services
1.1 Scope of Services.
The Program includes access to personalised coaching, training, group sessions, educational resources, and related services as outlined at the time of your enrolment (“Services”).
1.2 Participation.
You agree to participate actively and responsibly. You acknowledge that your results depend on your individual effort, consistency, and circumstances.
1.3 Health Declaration.
By enrolling, you confirm that you are in good physical and mental health to undertake exercise and have consulted your GP or healthcare provider if necessary.
2. Payments
2.1 Fees & Payment Schedule.
Program fees are payable in British Pounds Sterling (GBP), unless otherwise stated. Payment terms are confirmed during your enrolment.
Unless you are purchasing a 6-week program, all Bewaved coaching (1:1 or group) operates on a rolling subscription basis with a 3-month minimum commitment.
2.2 Payment Authorisation.
You authorise Bewaved to charge your nominated payment method for all payments due under this Agreement. Subscription payments will continue automatically each month unless cancelled in accordance with Clause 4.
2.3 Late or Failed Payments.
If a payment fails or becomes overdue:
We will attempt to reprocess the payment every 3 days.
After 3 failed attempts, your access may be suspended.
Overdue balances of 30 days or more will result in the remaining balance becoming immediately due.
Failure to settle within 7 days may result in your account being referred to a debt collection agency, which may impact your credit rating.
If you experience financial hardship, please contact us before your payment due date to discuss flexible arrangements.
2.4 Client Responsibility.
You remain responsible for all payments, including where fees are funded by a third party.
3. Refunds, Cancellations & Deferrals
3.1 30-Day Money-Back Guarantee.
For 1:1 Custom Coaching Programs only:
If you wish to cancel within the first 30 days, you must:
Complete all required assessments and programmed workouts in the Coaching App.
Submit your refund request by email before the 30-day period ends.
The 30-day period begins when you complete your first workout in the App.
3.2 Post-30-Day Cancellations.
After 30 days, refunds are not available. If you cancel early, the remaining balance for your minimum term becomes immediately due.
3.3 Deferrals & Suspensions.
If you experience medical incapacity or force majeure circumstances, you may request a single 4-week suspension of payments. Suspensions cannot coincide with cancellation notice periods. All requests require booking an exit call with your assigned coach.
3.4 Program Termination by Company.
If Bewaved cancels the Program before completion, you will receive a pro-rata refund of fees paid for unused portions.
4. Subscription & Notice Period
After your initial 3-month minimum term, your Program converts to a rolling monthly subscription.
You may cancel your subscription at any time with 1 month’s written notice before your next billing date by emailing [email protected]
Renewal payments will continue at your current rate unless we provide at least 14 days’ written notice of a change.
5. Intellectual Property
All Program content, materials, and resources remain the intellectual property of Bewaved. You receive a limited, non-transferable licence for personal use only. You may not reproduce, share, or distribute materials without written permission.
If you provide feedback or suggestions (“Improvements”), you assign all rights in those Improvements to Bewaved.
Breach of this clause may result in immediate termination of access without refund.
6. Privacy
Your personal data is processed in line with our Privacy Policy. You agree to the terms of that policy. Images or testimonials will only be used for marketing with your explicit consent.
7. Health & Medical Disclaimer
Program content is educational and does not constitute medical advice. Always consult your healthcare provider before making changes to your exercise or nutrition routines.
You acknowledge that all exercise carries inherent risks and that participation is voluntary. If you experience pain, dizziness, or discomfort, stop immediately and seek medical advice.
8. Client Responsibilities
You agree to:
Follow Program instructions safely and responsibly.
Disclose any changes in health that may impact participation.
Conduct yourself respectfully and lawfully.
Not share your access credentials or program materials.
Failure to comply may result in termination of access, with all fees remaining due.
9. Limitation of Liability
Nothing in this Agreement limits or excludes liability for death or personal injury caused by negligence or fraud.
To the fullest extent permitted by law:
We disclaim all warranties, express or implied.
We are not liable for indirect or consequential loss.
Our total liability is limited to the fees you have paid.
We are committed to providing high-quality support, but your individual results depend on your effort, consistency, and circumstances.
10. Indemnification
You agree to indemnify and hold harmless Bewaved and its affiliates against any claims arising from your breach of this Agreement or misuse of the Program, except to the extent caused by our negligence.
11. Changes to the Program
We may amend Program content, structure, or policies to improve delivery or ensure legal compliance. Where changes materially impact your experience, we will notify you in advance.
12. Severability & Waiver
If any provision of this Agreement is found unenforceable, the remainder remains in effect. Any failure to enforce rights does not constitute a waiver of those rights.
13. Governing Law & Dispute Resolution
This Agreement is governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of English courts.
We encourage resolving disputes amicably and agree to attempt mediation before commencing legal action.
14. Acknowledgement
By clicking “I agree”, signing this document, or completing payment, you confirm that you have read, understood, and agreed to this Agreement, and have had the opportunity to ask questions before enrolling.

We will keep your data for as long as necessary to fulfil the purposes we collected it for, including any legal, accounting, or reporting requirements.

Under UK GDPR, you have the right to:
